Scope
This data protection declaration explains to users the nature, scope and purposes of the collection and use of personal data by the responsible provider BERTRAND Food GmbH – Hansestr. 3 – 59590 Geseke on this website (hereinafter “offer”).
The legal basis for data protection can be found in the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).

Access data/ server log files
The provider (or his web space provider) collects data about every access to the offer (so-called server log files). The access data includes:
Name of the website called up, file, date and time of the call, amount of data transferred, notification of successful retrieval, browser type and version, the user’s operating system, referrer URL (the previously visited site), IP address and the requesting provider.
The provider uses the protocol data only for statistical evaluations for the purpose of operation, security and optimization of the offer. However, the provider reserves the right to check the protocol data subsequently if there is a justified suspicion of illegal use based on concrete evidence.

Usage of personal data
Personal data is information that can be used to determine a person, i.e. information that can be used to trace back to a person. This includes the name, e-mail address or telephone number. But also data about preferences, hobbies, memberships or which websites someone has visited are considered personal data.
Personal data is only collected, used and passed on by the provider if this is legally permitted or if the users agree to the collection of data.

Contact us
When contacting the provider, the user’s details are stored for the purpose of processing the enquiry and in the event that follow-up questions arise.

Our hotline is managed by MWC – Mobile World Communications GmbH, Schivelbeiner Str. 19, 10439 Berlin, Germany, which will forward incoming calls to our company’s employees if necessary.

We use the Zendesk ticketing system to process customer inquiries, a customer service platform of Zendesk Inc. 989 Market Street #300, San Francisco, CA 94102 Zendesk is a certified participant of the Safe Harbor Privacy Agreement and therefore fulfills the minimum requirements for order data processing in accordance with the law.

With the newsletter we inform you about us and our offers.

With the following notes we will inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your right to object. By subscribing to our newsletter, you agree to receive it and to the described procedures.

Content of the newsletter
We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter “newsletters”) only with the consent of the recipients or with a legal permission. If, in the course of registering for the newsletter, its contents are specifically described, they are decisive for the consent of the users. Furthermore, our newsletters contain information on legal topics, in particular in the field of marketing law, data protection and our law firm (this may include in particular references to blog posts, lectures or workshops, our services or online presence).

Double-Opt-In and logging
The registration to our newsletter is done in a so-called double opt-in procedure. This means that after registration you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that nobody can register with foreign e-mail addresses.

The newsletter registrations are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the registration and confirmation time as well as the IP address. Changes to your data stored with MailChimp are also logged.
Use of the dispatch service provider “MailChimp

The newsletters are sent via “MailChimp”, a newsletter dispatch platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The e-mail addresses of our newsletter recipients, as well as their other data described in this notice, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore MailChimp may use this data according to its own information to optimize or improve its own services, e.g. for technical optimization of sending and presentation of newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to contact them itself or pass them on to third parties.

We trust in the reliability and the IT- and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and therefore commits itself to comply with the EU data protection regulations. Furthermore, we have concluded a “Data-Processing-Agreement” with MailChimp. This is a contract in which MailChimp commits itself to protect the data of our users, to process it according to its data protection regulations on our behalf and especially not to pass it on to third parties. Registration data
To subscribe to the newsletter, it is sufficient to enter your e-mail address.

Optionally we ask you to enter your first and last name. This information is only used to personalize the newsletter. Furthermore, we also optionally ask you to enter your date of birth, gender and your industry. We only use this information to adapt the contents of the newsletter to the interests of our readers.

Statistical survey and analyses
The newsletters contain a so-called “web-beacon”, i.e. a pixel-sized file which is retrieved from the server of MailChimp when the newsletter is opened. In the context of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined by means of the IP address) or the access times.

Statistical surveys also include determining whether newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our nor MailChimp’s intention to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our contents to them or to send different contents according to the interests of our users.

Online access and data management
There are cases where we direct the newsletter recipients to the websites of MailChimp. E.g. our newsletters contain a link with which the newsletter recipients can retrieve the newsletters online (e.g. in case of display problems in the email program). Furthermore, newsletter recipients can correct their data, e.g. the e-mail address, afterwards. Also the privacy policy of MailChimp is only available on their site.

In this context we would like to point out that on the websites of MailChimp cookies are used and therefore personal data is processed by MailChimp, its partners and used service providers (e.g. Google Analytics). We have no influence on this data collection. Further information can be found in the privacy policy of MailChimp. We would also like to draw your attention to the possibility to object to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

Termination/Revocation
You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. Your consent to receive the newsletter via MailChimp and the statistical analyses will expire at the same time. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible.

Legal basis Basic data protection regulation
In accordance with the provisions of the Basic Data Protection Regulation (DSGVO) applicable from 25 May 2018, we hereby inform you that consent to the sending of e-mail addresses is given on the basis of Art. 6 (1) lit. a, 7 DSGVO and § 7 (2) no. 3, or (3) UWG. The use of the MailChimp service provider, the execution of the statistical surveys and analyses as well as the logging of the registration procedure are based on our legitimate interests according to article 6 paragraph 1 lit. f DSGVO. We are interested in the use of a user-friendly and secure newsletter system, which serves our business interests and meets the expectations of the users.

We would also like to point out that you can object to the future processing of your personal data in accordance with the legal requirements under Art. 21 DSGVO at any time. The objection can be made in particular against processing for the purposes of direct advertising.

Integration of services and contents of third parties
It can happen that within this online offer contents of third parties, such as videos from YouTube, map material from Google Maps, RSS feeds or graphics from other websites are integrated. This always presupposes that the providers of these contents (hereinafter referred to as “third-party providers”) are aware of the IP address of the users. Without the IP address, they would not be able to send the content to the browser of the respective user. The IP address is therefore necessary for the display of this content. We make every effort to use only such content whose respective providers use the IP address only to deliver the content. However, we have no influence on this if the third-party providers store the IP address for statistical purposes, for example. As far as we are aware of this, we inform the users about it.

Cookies
Cookies are small files that enable specific information related to the device to be stored on the user’s access device (PC, smartphone or similar). On the one hand, they serve the user-friendliness of websites and thus the users (e.g. storage of login data). On the other hand, they serve to record statistical data on website use and to be able to analyse it for the purpose of improving the offer. The users can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, it should be noted that the use and in particular the comfort of use will be restricted without cookies.

Registration function
The data entered during registration is used for the purpose of using the offer. Users can be informed by e-mail about information relevant to the offer or registration, such as changes in the scope of the offer or technical circumstances. The data collected can be seen in the input mask during registration.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; „Google“). The use includes the operating mode „Universal Analytics“. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous User-ID and thus analyze the activities of a user across devices. The dispatch is carried out via the dispatch portal “SendCloud” (SendCloud GmbH, Kanalstr. 10, 80538 Munich, Germany). We pass on your data to shipcloud exclusively for the purpose of processing your online order. PayPal
In case of payment via PayPal, credit card via PayPal, direct debit via PayPal or – if offered – “purchase on account” via PayPal, we will pass on your payment data to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”) within the scope of the payment processing. PayPal reserves the right to carry out a credit check for the payment methods credit card via PayPal, direct debit via PayPal or – if offered – “purchase on account” via PayPal. The result of the credit assessment with regard to the statistical probability of non-payment shall be used by PayPal for the purpose of deciding on the provision of the respective payment method. The credit report may contain probability values (so-called score values). If score values are included in the result of the credit report, they are based on a scientifically recognized mathematical-statistical procedure. If you choose one of the payment methods offered by the payment service provider Stripe Payments Europe Ltd, the payment processing is carried out by the payment service provider Stripe Payments Europe Ltd, Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland, to whom we pass on the information you provide during the ordering process together with the information about your order (name, address, possibly IBAN, possibly BIC, invoice amount, currency and possibly transaction number). The transfer of your data is exclusively for the purpose of payment processing with the payment service provider Stripe Payments Europe Ltd.

Cancellation, changes, corrections and updates
The user has the right to request information free of charge about the personal data stored about him/her. In addition, the user has the right to have incorrect data corrected, to block and delete his personal data, provided that this does not conflict with any legal obligation to preserve records.
